PUBLIC PARTICIPATION MEETING PROCESS

Anyone wishing to speak at a Public Participation Meeting can do so virtually using Zoom online or phone, or by attending in person. City Hall is currently open to the public for public participation meetings. If you wish to attend in person to speak to a matter that is on an agenda you are encouraged to pre-register by email or phone; however, should you wish to attend virtually, pre-registration is required.  To pre-register, please email PPMClerks@london.ca or call 519-661-2489, ext. 7100.  Please note that some Elected Officials may attend the meetings virtually.

NOTICE OF REVISED APPLICATION

The following applications were received and advertised on a previous date in The Londoner and have since been REVISED.  The Planning and Environment Committee will be considering these applications at a future public meeting, the date and time of which will be published in the Londoner. If you have any questions or would like to provide comment, please see “Providing Comment” below.

3563 Bostwick Road, on the south side of Pack Road, west of Bostwick Road; approx. 14.84 hectares (36.67 acres) - In the updated Notice of Application for the Draft Plan of Subdivision, changes have been made, including the consolidation of three (3) Blocks (Block 6, 9-10) into a one (1) Block (Block 9), along with adjustments to the estimated unit yield for each block. The purpose and effect of this application is to consider a proposed updated Draft Plan of Subdivision consisting of single detached dwellings, cluster townhouses, street townhouses, apartment buildings, parkland, open space, and served by three (3) public streets. Draft Plan of Subdivision – Consideration of a updated Draft Plan of Subdivision consisting of four (4) low density residential blocks with an estimated yield of 56 single detached dwelling units (Blocks 1-4); two (2) medium density residential block with an estimated yield of 22 street townhouse dwelling units (Block 5, 7); three (3) medium density residential blocks with an estimated yield of 312 apartment and cluster townhouse dwelling units (Block 8, 11-12); one (1) high density residential apartment and cluster townhouse block with an estimated yield of 960 units (Block 9); one (1) future road/residential development block (Block 13), one (1) park block (Block 14); two (2) open space block (Block 15-16); three (3) 0.3 metre reserve blocks (Blocks 17-19); served by three (3) new streets (Streets A, B and C). A Focused Environmental Impact Study – 3563 Bostwick Road (EIS) report prepared by MTE Consultants Inc., dated September 20, 2023, was submitted with the application for draft plan of subdivision. NOTICE OF INTENT TO REMOVE A HOLDING PROVISION 

City Council will consider removing the Holding Provisions as applied to the lands described below at a future Council Meeting.  Council will not hear representations from the public on these matters.  If you have any questions or comments about this matter, please call the planner identified below.

1300 Fanshawe Park Road East – The Delegated Authority for the City of London intends to consider removing the h and h-11 holding provision from a portion of the subject lands.  The purpose of the “h” provision is to ensure the orderly development of lands and the adequate provision of municipal services, the “h” symbol shall not be deleted until the required security has been provided for the development agreement or subdivision agreement, and Council is satisfied that the conditions of the approval of the plans and drawings for a site plan, or the conditions of the approval of a draft plan of subdivision, will ensure a development agreement or subdivision agreement is executed by the applicant and the City prior to development. The purpose of the “h-11” provision is to ensure the orderly development of lands and the adequate provision of municipal services, the "h-11" symbol shall not be deleted until a development agreement associated with a site plan which provides for appropriate access arrangements to the satisfaction of Council is entered into with the City of London. If a person or public body would otherwise have an ability to appeal the decision of the Corporation of the City of London or of the Approval Authority to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the City of London before the application is adopted or approved, the person or public body is not entitled to appeal the decision. 
If a person or public body does not make oral submissions at a public meeting or make written submissions to the City of London before the proposed amendment is adopted or approved, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.

CONSENTS

The London Consent Authority will be considering the following application for consent. Comments Due by Thursday July 4, 2024.

B.018/24 – 1300 Fanshawe Park Road East - Permission to sever a parcel with a lot area of 43,245m2 (10.63 acres) and a lot frontage of 165m for the purpose of future commercial uses and to retain a parcel with a lot area of 67,784m2 (16.75 acres) and a lot front of 175m for the purpose of future commercial and residential uses. If a person or public body that files an appeal of a decision of the City of London Consent Authority in respect of the proposed consent does not make written submissions to the Consent Authority, before it gives or refuses to give a provisional consent, the Ontario Land Tribunal (OLT) may dismiss the appeal. Please be advised that from March 4 to July 31, 2024, the front (south) entrance to City Hall will be closed to visitors and staff while repair and rehabilitation work takes place. During this time pedestrian traffic will be redirected to the north entrance located off Reginald Cooper Square. Access from the lower-level parking garage to the City Hall elevators will still be available.

 

NOTICES

NOTICE OF REPEAL OF HERITAGE DESIGNATION BY-LAW - TAKE NOTICE THAT the Council of The Corporation of the City of London has passed By-law No. L.S.P.-3517-142 at its meeting on June 4, 2024 to repeal the heritage designating by-law for the property at 432 Grey Street. 

The African Methodist Episcopal Church (formerly referred to as the Fugitive Slave Chapel) was relocated from 432 Grey Street to Fanshawe Pioneer Village. With the relocation of the building, the property at 432 Grey Street no longer has cultural heritage value or interest. Pursuant to Section 7(1) subparagraph 4i of Ontario Regulation 385/21, if a property no longer has cultural heritage value or interest as the result of removal of a building from the property, Municipal Council shall pass a by-law to repeal the by-law designating the property under the Ontario Heritage Act.

NOTICE OF ADOPTION OF AN OFFICIAL PLAN AMENDMENT, C.P.-1512(dg)-139 (OPA 111) - TAKE NOTICE that the Municipal Council of The Corporation of the City of London passed by-law C.P.-1512(dg)-139 under section 17 of the Planning Act, R.S.O. 1990, c. P.13, as amended, for the purpose of adopting Amendment No. 111 (OPA 111) to the Official Plan for the City of London Planning Area - 2016 on June 4, 2024.

PURPOSE AND EFFECT OF THE OFFICIAL PLAN AMENDMENT: The purpose and effect of the amendments are to improve clarity and consistency within the environmental policies and maps of The London Plan. It will reflect changes to provincial ministries, Council’s committees, policy documents and legislation. The amendments to Map 1 – Place Types, Map 5 – Natural Heritage and Map 6 – Hazards and Natural Resources will update mapping based on past development applications, and recent City-initiated projects that have resulted in changes.

RELATED APPLICATIONS: The land to which the by-law applies is not the subject of an application under the Planning Act for an amendment to a zoning by-law, for a minor variance or a consent, a Minister’s Zoning Order, or for approval of a plan of subdivision.

WHO MAY FILE AN APPEAL: Only individuals, corporations, and public bodies may appeal a by-law to the Ontario Land Tribunal (OLT). A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf. No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party. Please see the Planning Act for updated appeal requirements.
