PUBLIC PARTICIPATION MEETING PROCESS

Anyone wishing to speak at a Public Participation Meeting can do so virtually using Zoom online or phone, or by attending in person. City Hall is currently open to the public for public participation meetings. If you wish to attend in person to speak to a matter that is on an agenda you are encouraged to pre-register by email or phone; however, should you wish to attend virtually, pre-registration is required.  To pre-register, please email PPMClerks@london.ca or call 519-661-2489, ext. 7100.  Please note that some Elected Officials may attend the meetings virtually.

The Committee of Adjustment for the City of London will meet on Thursday, November 17, 2022, commencing at 1:30 p.m., for the purpose of hearing the following applications for Minor Variance to Zoning By-law Z.-1. Public hearings before the committee are held virtually. 1:30 p.m. – A.125/22 - 44 Springbank Drive, PLAN 376 BLK B PT LOT 3 IRREG AC 31.00FR D. Reduce Lot frontage for duplex. To permit a lot frontage of 9.4m for a duplex dwelling whereas 12.0m is otherwise required. To permit a main storey deck located 0.7m from the west interior lot line, whereas the provided projection is to be no closer than 1.2m. To permit a second storey deck 0.7m from the west interior lot line and 1.2m from the east interior lot line, whereas 1.8m and 3.0m are required respectively.

1:30 p.m. – A.132/22 – 1940 Richmond Street PLAN 723 LOT 35 TO 36 140.6X263.2X276.1X158.9 1.00AC  140.60FR. To construct an addition (cabana). To permit an exterior side yard of 1.5m whereas, 8m is the minimum required. To permit an accessory structure (Cabana) within an exterior side yard whereas, accessory structures are restricted to the interior side yards or rear yard.

1:30 p.m. – A.135/22 - 875 William Street, PLAN 213 LOT 45. To permit reduced lot frontages for a semi-detached dwelling. To permit a lot frontage of 8.0m whereas a minimum lot frontage of 8.5 is required.

To permit a residential garage width of 95% of the main building façade width, whereas 50% is the maximum permitted.  To permit an accessory structure lot coverage of 12.7%, whereas 10% is the maximum permitted.

1:30 p.m. – A.127/22 - 6951 Clayton Walk, 39T-00510 Phase 3 Lot 23 Corner Lot onto Colonel Talbot Road. To permit a pool in the exterior side yard.  To permit a private open swimming pool located in the exterior side yard, whereas they are permitted in an interior side yard or rear yard on a lot containing a permitted dwelling. To permit an interior wall surface of a private open swimming pool 4.0 metres from the street line, whereas 8.0 metres is the minimum setback required therefrom.

1:30 p.m. – A-134/22 - 735 Wonderland Road North, PLAN 216 PT LOT 16,21.  To add two buildings to an existing neighbourhood shopping centre.  To permit a maximum lot coverage of 32.5% whereas a maximum lot coverage of 30% is permitted. To permit a parking area setback of 1.6 metres from the road allowance whereas 3.0 metres is the minimum required. 

1:30 p.m. – A136/22 - 3505 Morgan Avenue - PLAN 33M661 BLK 6. To permit the development of a two-storey multi-use commercial plaza and one-storey drive-through restaurant. A front and exterior side yard setback of 1.0m is required whereas 9.0m is otherwise required based on the height of the proposed building.

If you wish to be notified of a decision of the Committee of Adjustment, you must appear in person or by Counsel at the hearing and file a written request with the Secretary-Treasurer of the Committee of Adjustment.  An appeal from a decision of the Committee of Adjustment to the Ontario Land Tribunal shall be filed within 20 days of making the decision. Any appeal must be filed with the Secretary-Treasurer of the Committee of Adjustment, in person at 6th Floor, City Hall, 300 Dufferin Ave., London, ON, or Mail to City of London, P.O. CONSENTS

The London Consent Authority will be considering the following application for consent. Comments are due Thursday, November 17, 2022, to the London Consent Authority.

B.033/22 – 95 and 103 Elmwood Street. Permission to sever and convey Parcel B to Parcel C with a total area of 1553 m2 and a lot frontage of 8 metres and retain Parcel A with an area of 1202m2 with a lot frontage of 20.4 metres. Planner: M. Hynes

If a person or public body that files an appeal of a decision of the City of London Consent Authority in respect of the proposed consent does not make written submissions to the Consent Authority, before it gives or refuses to give a provisional consent, the Ontario Land Tribunal (OLT)  may dismiss the appeal. Notice of Passing of a Zoning By-law Z.-1 Amendment, Z.-1-223064 - TAKE NOTICE that the Municipal Council of The Corporation of the City of London passed By-law Z.-1-223064 under section 34 of the Planning Act, R.S.O. 1990, c. P.13, as amended, on October 17, 2022.

AND TAKE NOTICE THAT only individuals, corporations, and public bodies may appeal a by-law to the Ontario Land Tribunal (OLT). A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf. No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.

WHEN AND HOW TO FILE AN APPEAL: An appeal to the Ontario Land Tribunal (OLT) must be filed with the City Clerk of The Corporation of the City of London at the address shown above NO LATER THAN 4:30 p.m. on the 16th day of November 2022; set out the reasons for the appeal; the appellant form is available from the Ontario Land Tribunal at www.olt.gov.on.ca; and, be accompanied by the fee prescribed under the Ontario Land Tribunal Act, 2021, payable to the Minister of Finance.

RELATED APPLICATIONS: The land to which the by-law applies is not the subject of an application under the Planning Act for a minor variance or a consent, for an amendment to an official plan, a Minister’s zoning order, or for approval of a plan of subdivision.

PURPOSE AND EFFECT OF THE ZONING BY-LAW AMENDMENT: The recommended amendment to the Zoning By-law Z.-1 is intended to assist local restaurant owners by providing additional outdoor seating at their establishments. The months of operation and capacity limits for seasonal outdoor patios are in keeping with the Liquor Licence and Control Act.
