PUBLIC PARTICIPATION MEETING PROCESS

Anyone wishing to speak at a Public Participation Meeting can do so virtually using Zoom online or phone, or by attending in person. City Hall is currently open to the public for public participation meetings. If you wish to attend in person to speak to a matter that is on an agenda you are encouraged to pre-register by email or phone; however, should you wish to attend virtually, pre-registration is required.  To pre-register, please email PPMClerks@london.ca or call 519-661-2489, ext. 7100.  Please note that some Elected Officials may attend the meetings virtually.

NOTICE OF PUBLIC MEETING

The Planning and Environment Committee will consider the following matters at a Public Participation Meeting to be held Monday, June 12, 2023. Standing Committee and Council Meetings are virtual meetings hosted in City Hall, Council Chambers. Participation of some Council Members and staff will be virtual.  Meetings can be viewed via live-streaming on YouTube and the City website.  There is additional information on the City of London website www.london.ca about Public Participation Meetings. Information regarding the matter being considered at the Public Participation Meeting will be posted on the City of London website at www.london.ca on Wednesday, June 7, 2023.  Written submissions regarding this matter to be included on the Planning and Environment Committee Added Agenda are to be submitted no later than 9:00 AM on Friday, June 9, 2023 either delivered or mailed to the City Clerk’s Office, Room 308, 300 Dufferin Avenue, P.O. 221 Queens Avenue – The purpose and effect of this zoning change is to permit the continued operation of the existing commercial parking lot use on the subject lands for an additional three (3) years. Possible change to Zoning By-law Z.-1 BY AMENDING the temporary use provisions of the existing Holding Downtown Area Temporary Use (h-3*DA2*D350/T-69) Zone TO PERMIT the temporary commercial parking lot for an additional three (3) years. NOTICE OF INTENT TO REMOVE A HOLDING PROVISION

City Council will consider removing the Holding Provisions as applied to the lands described below at a future Council Meeting.  Council will not hear representations from the public on these matters.  If you have any questions or comments about this matter, please call the planner identified below.

991 Sunningdale Road West – The Delegated Authority for the City of London intends to consider removing the h-18 holding provision from the subject lands to allow a development of single family dwelling units.  The purpose of the “h-18” provision is to ensure that the proponent shall retain a consultant archaeologist, licensed by the Ministry of Tourism, Culture and Sport (MTCS) under the provisions of the Ontario Heritage Act (R.S.O. 1990 as amended) to carry out a Stage 1 (or Stage 1-2) archaeological assessment of the entire property. Development or property alteration shall only be permitted on the subject property containing archaeological resources or areas of archaeological potential if the archaeological resources have been conserved by removal and documentation, or by site preservation (Stages 3 and 4). The archaeological assessment must be completed in accordance with the most current Standards and Guidelines for Consulting Archaeologists. Engagement with the appropriate First Nations shall be completed consistent with the policies of The London Plan. All archaeological assessment reports, in both hard copy format and digitally in Portable Document Format (PDF), will be submitted to the City of London once MTCS has accepted them into the Public Registry. Significant archaeological resources will be incorporated into the proposed development through either in situ preservation or interpretation where feasible or may be commemorated and interpreted on site. No demolition, new exterior construction, grading, or any other activity where soil disturbance will occur or might be reasonably anticipated, shall take place on the subject property prior to the City of London receiving the MTCS compliance letter indicating that all archaeological licensing and reporting requirements have been satisfied. If a person or public body would otherwise have an ability to appeal the decision of the Corporation of the City of London or of the Approval Authority to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the City of London before the application is adopted or approved, the person or public body is not entitled to appeal the decision.
If a person or public body does not make oral submissions at a public meeting or make written submissions to the City of London before the proposed amendment is adopted or approved, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.

CONSENTS

Notice of Adoption of an Official Plan Amendment, C.P.-1512(cb)-107 (OPA 80)

TAKE NOTICE that the Municipal Council of The Corporation of the City of London passed by-law C.P.-1512(cb)-107 under section 17 of the Planning Act, R.S.O. 1990, c. P.13, as amended, for the purpose of adopting Amendment No. 80 (OPA 80) to the Official Plan for the City of London Planning Area - 2016 on May 16, 2023.

AND TAKE NOTICE that only individuals, corporations, and public bodies may appeal a by-law to the Ontario Land Tribunal (OLT). A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf. No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.

RELATED APPLICATIONS: The land to which the by-law applies is not the subject of an application under the Planning Act for an amendment to a zoning by-law, the subject for a minor variance or a consent, a Minister's Zoning Order, or for approval of a  plan of subdivision.

PURPOSE AND EFFECT OF THE OFFICIAL PLAN AMENDMENT:  The purpose and effect of the recommended action is to amend the Official Plan to change the requirement for public meetings for vacant land condominiums and common elements condominiums under policy 1619 and to remove policy 1683 in its entirety.

WHEN COUNCIL’S DECISION IS FINAL: The proposed official plan amendment is exempt from approval by the Minister of Municipal Affairs and Housing. The decision of the Council is final if a notice of appeal is not received on or before the last day for filing a notice of appeal.
