PUBLIC PARTICIPATION MEETING PROCESS

Anyone wishing to speak at a Public Participation Meeting can do so virtually using Zoom online or phone, or by attending in person. City Hall is currently open to the public for public participation meetings. If you wish to attend in person to speak to a matter that is on an agenda you are encouraged to pre-register by email or phone; however, should you wish to attend virtually, pre-registration is required.  To pre-register, please email PPMClerks@london.ca or call 519-661-2489, ext. 7100.  Please note that some Elected Officials may attend the meetings virtually.

NOTICE OF APPLICATION

The following applications have been received by the City of London.  The Planning and Environment Committee will be considering these applications at a future public meeting, the date and time of which will be published in the Londoner. If you have any questions or would like to provide comment, please see “Providing Comment” below.

1560 Dundas Street – The purpose and effect of this zoning change is to permit a broader range of uses within the existing building. Possible change to Zoning By-law Z.-1 FROM an Associated Shopping Area Commercial (ASA1/ASA4) Zone TO an Associated Shopping Area Commercial Special Provision (ASA1(_)/ASA3(_)/ASA4(_)) Zone. Special provisions would recognize existing site conditions and permit the existing number of parking spaces for all permitted uses within the existing building. The City may also consider additional considerations such as a different base zone, the use of holding provisions, and/or additional special provisions. File: Z-9715. Planner: C. Maton.

Housekeeping Amendment to The London Plan – The purpose and effect of this amendment to the London Plan is to improve clarity and consistency on the environmental policies and mapping throughout the Plan. This amendment is of a housekeeping nature to correct errors and omissions in the Plan (minor changes to certain policies, figures, and maps to refine wording and formatting), remove references to older terminologies to reflect changes to provincial ministries, policy documents and recent legislation (Bill 23 (More Homes Built Faster Act)), and changes to Map 1 – Place Types, Map 5 – Natural Heritage and Map 6 – Hazards and Natural Resources to reflect changes as a result of development applications approved by Council since 2017. File: O-9693 Planner: S. 376-390 Hewitt Street and 748 King Street – The purpose and effect of this zoning change is to permit the continued operation of the temporary surface residential parking lot on the subject properties for an additional three (3) years. Possible change to Zoning By-law Z.-1 BY AMENDING the temporary use provisions of the existing Business District Commercial Temporary Use (BDC(2)/T-79) Zone and Residential Temporary Use (R8-4/T-79) Zone TO PERMIT the temporary residential parking lot for an additional three (3) years. NOTICE OF INTENT TO REMOVE A HOLDING PROVISION 

City Council will consider removing the Holding Provisions as applied to the lands described below at a future Council Meeting.  Council will not hear representations from the public on these matters.  If you have any questions or comments about this matter, please call the planner identified below.

1357 Hyde Park Road – The Delegated Authority for the City of London intends to consider removing the h and h-100 holding provisions from the subject lands to allow for the development of street townhouse units.  The purpose of the “h” holding provisions is to ensure the orderly development of lands and the adequate provision of municipal services, the “h” symbol shall not be deleted until the required security has been provided for the development agreement or subdivision agreement, and Council is satisfied that the conditions of the approval of the plans and drawings for a site plan, or the conditions of the approval of a draft plan of subdivision, will ensure a development agreement or subdivision agreement is executed by the applicant and the City prior to development. The purpose of the “h-100” holding provisions is to ensure there is adequate water service and appropriate access, a looped watermain system must be constructed and a second public access must be available to the satisfaction of the City Engineer, prior to the removal of the h-100 symbol. 3429, 3435, 3439, 3443, 3447, 3451, 3455 Paul Peel Avenue – The Delegated Authority for the City of London intends to consider removing the h-11 holding provision from the subject lands to allow for the development of single-family homes. The purpose of the “h-11” holding provisions is to ensure the orderly development of lands and the adequate provision of municipal services, the "h-11" symbol shall not be deleted until a development agreement associated with a site plan which provides for appropriate access arrangements to the satisfaction of Council is entered into with the City of London. The Delegated Authority will consider removing the holding provisions as they apply to these lands no earlier than April 3, 2024.

If a person or public body would otherwise have an ability to appeal the decision of the Corporation of the City of London or of the Approval Authority to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the City of London before the application is adopted or approved, the person or public body is not entitled to appeal the decision. 
If a person or public body does not make oral submissions at a public meeting or make written submissions to the City of London before the proposed amendment is adopted or approved, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.

To permit a minimum front yard setback of 0.0m whereas 15.0m is the minimum required. To permit a minimum east exterior side yard setback of 1.0m whereas 15.0m is the minimum required. To permit a west exterior side yard setback of 3.5m whereas 15.0m is the minimum required. To permit a minimum front yard parking area setback of 2.4m whereas parking is to be located no closer than 3.0m to any required road allowance. To permit 9 stacking spaces for a coffee shop whereas 15 stacking spaces for a coffee shop is the minimum required.

To permit a minimum rear yard setback of 1.9m, whereas 7.2m is the minimum required. To permit a minimum of 221 parking spaces, whereas 256 is the minimum required. To permit zero (0) Type ‘B’ standard parking spaces, whereas four (4) Type ‘B’ is the minimum required.

1:30 p.m. - A.026/24 - 49 Forward Avenue, PLAN 431 LOTS 16,17. Permission to sever a lot (Parcel A) with an area of 284m² and a lot frontage of 10.1m and retain a lot (Parcel B) with an area of 410.7m² and a lot frontage of 10.9m. Retailed Lands: To permit a minimum east interior side yard depth of 1.8m whereas 3.0m is the minimum interior side yard depth required. NOTICE OF CANCELLATION – PUBLIC MEETING – Demolition Request for the Heritage Listed Properties at 924 Dundas Street and 930 Dundas Street has been cancelled. This matter was previously advertised on February 29, 2024, to be considered by the Planning and Environment Committee at its meeting March 19, 2024 - Item not to be heard before 1:00 p.m. This matter will be considered at a future Public Meeting. NOTICE OF CANCELLATION – PUBLIC PARTICIPATION MEETING – Pertaining to the Display of Graphic Images on a Street – The Public Participation Meeting advertised March 7, 2024, to be heard before the Community and Protective Services Committee at its meeting March 18, 2024, is hereby CANCELLED. The Committee will not be considering amendments to the Streets By-law S-1 at this meeting. This applies only to the PPM regarding the display of graphic images on a street. Information regarding the above-noted matter will be posted on the City of London’s website at www.london.ca.  Any questions related to the amendments may be referred to Ethan Ling via email: eling@london.ca. Future PPMs on this subject, if necessary, will be advertised here.

NOTICE OF COMPLETION – Hamilton Road at Gore Road Intersection Improvements – Municipal Class Environmental Assessment – The City of London has completed a Municipal Class Environmental Assessment (EA) for the improvements to the intersection of Hamilton Road and Gore Road. The study reviewed the options and identified the preferred solution to accommodate the increasing amount of traffic and address the mobility and safety concerns of pedestrians, cyclists and motorists at this intersection.

The study was conducted in accordance with the requirements of Schedule ‘B’ projects as outlined in the Municipal Class EA document (2000, as amended in 2007, 2011, 2015 and 2023), which is approved under the Ontario Environmental Assessment Act. 

A Project File Report (PFR) documenting the planning process undertaken, details of the study recommendations as well as potential impacts and mitigation measures, has been completed and by this Notice is being placed in the public record for review.  The PFR will be available for review for 30 days, starting March 25, 2024, and ending April 25, 2024 on the City’s website (https://getinvolved.london.ca/gorehamilton), at the London City Hall – City Clerk 3rd Floor (300 Dufferin Ave) during regular hours of operation Monday to Friday, and at the London Public Library – Crouch Branch (550 Commissioners Rd E) during regular hours of operation.

In addition, a request may be made to the Ministry of the Environment, Conservation and Parks for an order requiring a higher level of study (i.e. requiring an individual/comprehensive EA approval before being able to proceed), or that conditions be imposed (e.g. require further studies), only on the grounds that the requested order may prevent, mitigate or remedy adverse impacts on constitutionally protected Aboriginal and treaty rights. Requests on other grounds will not be considered.  Requests should include the requester contact information and full name for the ministry. 

Requests should specify what kind of order is being requested, how an order may prevent, mitigate or remedy those potential adverse impacts, and any information in support of the statements in the request. This will ensure that the ministry is able to efficiently begin reviewing the request.
