 NOTICE OF APPLICATION

The following applications have been received by the City of London.  The Planning and Environment Committee will be considering these applications at a future public meeting, the date and time of which will be published in the Londoner.  If you have any questions or would like to provide comment, please see “Providing Comment” below.

City Wide – Encouraging the Growing of Food in Urban Areas - The purpose and effect of the London Plan and zoning changes are to make it easier to grow food in the urban area of the City by removing, adding or changing existing policies and regulations which currently prevent that from happening. Council adopted the Urban Agriculture Strategy in November 2017 which includes a number of actions involving Growing; Processing, Distribution; Food Recovery and Loss; and Education and Connection to make it easier for people to grow their own food and provide access to fresh food for other City residents. This project focuses on the “Growing” component of the Strategy. Implementation of the Strategy is urban agriculture community driven and is generally confined to lands within the Urban Growth boundary (UGB). The intent of the changes is to make it easier to grow food outdoors, inside buildings, allow for more greenhouses in more areas and other initiatives to allow the growing of food. On July 6, 2021 Council directed that the draft amendments and background study be circulated for comments. Any comments can be directed to Chuck Parker at cparker@london.ca by Friday, August 20th. SoHo Community Improvement Plan

The purpose and effect of this application is a Community Improvement Plan amendment, pursuant to Section 28 of the Planning Act and pursuant to Section 21 to amend The London Plan (Our Tools: Community Improvement Plan Section). Possible amendment to ADD an Appendix to the SoHo Community Improvement Plan that identifies performance measures, indicators of success, and targets for the Upgrade to Building Code Loan, Façade Improvement Loan, and Rehabilitation and Redevelopment Tax Grant programs. When met, the targets will inform Civic Administration to modify the incentive programs, including potentially reducing grant or loan funding, or to discontinue the incentive program. Lambeth Community Improvement Plan

The purpose and effect of this is application is a Community Improvement Plan amendment, pursuant to Section 28 of the Planning Act and pursuant to Section 21 to amend The London Plan (Our Tools: Community Improvement Plan Section). Possible amendment to the Lambeth Community Improvement Plan to ADD an Appendix that identifies performance measures, indicators of success, and targets for the Façade Improvement Loan and the Wharncliffe Road Corridor Sign Loan programs. Hamilton Road Community Improvement Plan

1150 Fanshawe Park Road East Consideration of a Site Plan Control application to permit the construction of one three-storey stacked townhouse block and one six-storey apartment building with a total of 87 residential units. The current zoning was approved as a Holding Restricted Office/Convenience Commercial Special Provision/Residential R8 Special Provision Bonus (h-5*h-18*RO2/CC5(1)/R8-4(60)*B-70) Zone which permits the proposed stacked townhouse and apartment building. The zoning on this site includes the holding provision to require a public site plan meeting before the Planning and Environment Committee. The proposed site plan will be presented at a future meeting of the Planning and Environment Committee for the purpose of receiving comments for the Site Plan Approval Authority. If a person or public body would otherwise have an ability to appeal the decision of the Corporation of the City of London or of the Approval Authority to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the City of London before the application is adopted or approved, the person or public body is not entitled to appeal the decision.
If a person or public body does not make oral submissions at a public meeting or make written submissions to the City of London before the proposed amendment is adopted or approved, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.

EXPROPRIATIONS ACT
NOTICE OF APPLICATION FOR APPROVAL TO EXPROPRIATE LAND

IN THE MATTER OF an application by The Corporation of the City of London for approval to expropriate land in the City of London for the purposes of road improvements to Dingman Drive between Wellington Road and Highway 401.

NOTICE IS HEREBY GIVEN that application has been made for approval to expropriate the land described as follows:

Parcel 1: Part of Lot 16, Concession 3, Geographic Township of Westminster, in the City of London, County of Middlesex, designated as Part 9 on Plan 33R-20902 being Part of PIN 08204-0199(LT);

Parcel 2: Part of Lot 17, Concession 4, Geographic Township of Westminster, in the City of London, County of Middlesex, designated as Part 1 on Plan 33R-20902, being Part of PIN 08204-0086(LT).

Any owner of lands in respect of which notice is given who desires a hearing into whether the taking of such land is fair, sound and reasonably necessary in the achievement of the objectives of the expropriating authority shall so notify the approving authority in writing,

(a)      in the case of a registered owner, served personally or by registered mail within thirty days after the registered owner is served with the notice, or, when the registered owner is served by publication, within thirty days after the first publication of the notice;

(b)      in the case of an owner who is not a registered owner, within thirty days after the first publication of the notice.

Arva Pumping Station to Huron Street Transmission Main Municipal Class Environmental Assessment Master Plan
The City of London (City) has completed a Municipal Class Environmental Assessment (MCEA) master plan study to develop short and long-term maintenance and improvement/expansion plans for the Arva Huron Water Transmission Main between the Arva Pumping Station and Huron Street.  This study included an assessment of the need to maintain and/or potentially widen the existing transmission main easement to continue ongoing monitoring of the condition of the watermain and/or for potential maintenance, repair or replacement of the existing watermain.
The study determined that the short-term maintenance alternative is to maintain the easement as is (15m or 50’) and only expand where opportunities may arise through land use changes.  This ensures access to the existing transmission main for ongoing monitoring, maintenance and/or repair purposes without requiring the purchase of additional easement or property.
The study also determined that the preferred long-term expansion alternative is to twin the transmission main along Adelaide Street to add system capacity and redundancy with a connection to the existing transmission mains at Fanshawe Park Road and on Regent Street.  This will also provide the opportunity for eventual decommissioning of the existing water transmission main between Fanshawe Park Road and Huron Street in the future.
A Master Plan Project File has been prepared and a copy will be placed on public record on July 12th, 2021 for forty five (45) calendar days to be reviewed by members of the public and/or any other interested party at the following locations: The City of London – 300 Dufferin Avenue - City Clerk, 3rd floor, The London Public Library Central Branch 251 Dundas Street and on the City’s website at:  https://london.ca/projects/arva-pumping-station-huron-street-water-transmission-main-master-plan.
Interested persons are encouraged to review the document and provide comments to the City of London by August 27, 2021. If concerns regarding this project cannot be resolved in discussion with the City of London, the Ministry of Environment Conservation and Parks will have an additional 30-day window to review the study and decide what action to take.

Notice of Study Completion
Pottersburg Creek Sanitary Trunk Sewer

The City of London has completed a Municipal Class Environmental Assessment (Class EA) to investigate re-alignment of the Pottersburg Creek Sanitary Trunk Sewer. The study was undertaken in accordance with Schedule ‘B’ project requirements with the Municipal Engineers Association Municipal Class Environmental Assessment process (2000, as amended in 2007, 2011, and 2015).

Consultation:

The Notice of Commencement was distributed in January 2020. Due to COVID-19 restrictions, an in-person Public Information Centre (PIC) was not held. In lieu of an in-person PIC, a series of video presentations were made available on the project website to provide information on the study and solicit input from the public, agencies, and First Nations communities. The formal comment period was open from April 1, 2021 to June 18, 2021.

30-Day Public Review Period:

A Project File documenting the decision-making process and environmental mitigation measures has been compiled and by this notice will be placed on public record for the statutory 30-day public review period from Friday, July 23 to Monday, August 23,2021.

The Project File will be available online at: www.london.ca/pottersburgea. Alternatively, a hard copy of the Project File will be available for viewing at City Hall and the London Public Library – Dundas East (2016 Dundas Street, London).
