PUBLIC PARTICIPATION MEETING PROCESS

Anyone wishing to speak at a Public Participation Meeting can do so virtually using Zoom online or phone, or by attending in person. City Hall is currently open to the public for public participation meetings. If you wish to attend in person to speak to a matter that is on an agenda you are encouraged to pre-register by email or phone; however, should you wish to attend virtually, pre-registration is required.  To pre-register, please email PPMClerks@london.ca or call 519-661-2489, ext. 7100.  Please note that some Elected Officials may attend the meetings virtually.

MINOR VARIANCES

The Committee of Adjustment for the City of London will meet on Thursday August 11, 2022, commencing at 1:30 p.m., for the purpose of hearing the following applications for Minor Variance to Zoning By-law Z.-1. Due to the COVID-19 emergency in the Province of Ontario, public hearings before the committee will be held virtually. Those who wish to attend the public hearing, or to provide written submissions regarding the matter should contact CoAregister@london.ca / CofAsubmit@london.ca Secretary - Treasurer, London Committee of Adjustment at 519-930-3500 by 4:30 p.m. the day before the committee meeting. Additional information regarding the matter being considered by the committee is available to the public for inspection by contacting the Secretary-Treasurer, London Committee of Adjustment.

1:30 p.m. – A.099/22 – 1045 Hamilton Road, PLAN 285 PT LOTS 36,37, South side of Hamilton, east of Meadowlily Road North.  To construct an accessory structure with an additional residential dwelling unit. To permit an accessory structure with a west interior side yard setback of 1.7 metres whereas 5.2 metres is required and to permit an accessory structure with a height of 8.6 metres whereas 6 metres is the maximum permitted.

1:30 p.m. – A.100/22 – 918 Wellington Street, PLAN 245 PT LOT 2, east side of Wellington Street, north of Cheapside Street. To construct a second storey addition. To permit a north interior side yard setback of 0.5 metres whereas 0.6 metres is the minimum required.

1:30 p.m. – A.101/22 – 1525 Chickadee Trail, west side of Chickadee Trail, north of Hamilton Road. To permit a minimum lot frontage of 6.8 metres per lot whereas 7.0  metres is the minimum required. To permit a maximum lot coverage of 47% per lot whereas 45% per lot is the minimum permitted.

If you wish to be notified of a decision of the Committee of Adjustment, you must appear in person or by Counsel at the hearing and file a written request with the Secretary-Treasurer of the Committee of Adjustment.  An appeal from a decision of the Committee of Adjustment to the Ontario Land Tribunal shall be filed within 20 days of making the decision. Any appeal must be filed with the Secretary-Treasurer of the Committee of Adjustment, in person at 6th Floor, City Hall, 300 Dufferin Ave., London, ON, or Mail to City of London, P.O. CONSENTS

The London Consent Authority will be considering the following application for consent.  Comments Due By: July 28, 2022.

B.025/22– 942 Westminster Drive - Request to sever Parcel 1 with an area of 11,900m2 and a lot frontage of 70m and retain Parcel 2 with an area of 395,000m2 with a lot frontage of 130.2m. The existing residential dwelling and 2 accompanying accessory structures on the severed parcel will remain, and the retained parcel will be consolidated with the abutting agricultural property.  Planner: A. The London Consent Authority will be considering the following application for consent no earlier than 1:30 p.m. August 11, 2022.

B.022/22 – 466 South Street & 90 Maitland Street. Request To sever 6 lots (Parts 2-7) each approximately 304m² in size for the purpose of future residential uses (3 semi-detached dwellings) and to retain approximately 1474m² (Part 1) for the purpose of maintaining the existing restaurant/lodging house/apartment uses. If a person or public body that files an appeal of a decision of the City of London Consent Authority in respect of the proposed consent does not make written submissions to the Consent Authority, before it gives or refuses to give a provisional consent, the Ontario Land Tribunal (OLT)  may dismiss the appeal. NOTICES

Notice of Public Participation Meeting – Meeting of the Strategic Priorities and Policy Committee – Municipal Accommodation Tax on Short-Term Rentals on July 27, 2022 not to be heard before 4:05 PM, City Hall, Council Chambers, 300 Dufferin Avenue. On June 14, 2022, Municipal Council approved new licensing on short-term rentals with the intention of collecting Municipal Accommodation Tax on these rentals once the licensing is required. On July 27, 2022, the Strategic Priorities and Policy Committee will be holding a Public Participation Meeting to consider the by-law and agreement required to begin collecting Municipal Accommodation Tax on short-term rentals. Written submissions regarding this matter to be included on the Strategic Priorities and Policy Committee Added Agenda for the meeting should be submitted by no later than 9:00 a.m. on Monday, July 25, 2022 either delivered or mailed to the City Clerk’s Office, Room 308, 300 Dufferin Ave P.O. Notice of Adoption of an Official Plan Amendment, C.P.-1512(bm)-202 (OPA 65) - TAKE NOTICE that the Municipal Council of The Corporation of the City of London passed by-law C.P.-1512(bm)-202 under section 17 of the Planning Act, R.S.O. 1990, c. P.13, as amended, for the purpose of adopting Amendment No. 65 (OPA 65) to the Official Plan for the City of London Planning Area - 2016 on July 5, 2022.

AND TAKE NOTICE that only individuals, corporations, and public bodies may appeal a by-law to the Ontario Land Tribunal (OLT). A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf. No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.

RELATED APPLICATIONS: The land to which the by-law applies is not the subject of an application under the Planning Act for a minor variance or a consent, for an amendment to a zoning by-law, a Minister’s Zoning Order, or for approval of a plan of subdivision.

WHEN AND HOW TO FILE AN APPEAL: An appeal to the Ontario Land Tribunal (OLT) must be filed with the City Clerk of The Corporation of the City of London at the address shown above NO LATER THAN 4:30 p.m. on the 3rd day of August 2022; set out the reasons for the appeal; the appellant form is available from the Ontario Land Tribunal at www.olt.gov.on.ca; and, be accompanied by the fee prescribed under the Ontario Land Tribunal Act, 2021, payable to the Minister of Finance.

PURPOSE AND EFFECT OF THE OFFICIAL PLAN AMENDMENT: The purpose and effect of the recommended action is to implement some of the changes to the Planning Act made through Bill 13, Supporting People and Businesses Act, 2021, which allows Council to delegate approval authority under Section 34 (Zoning By-laws) that are of a minor nature to staff. The authority will include delegating decisions for removal of holding symbols and other minor zoning by-law amendments. The recommended action will also permit alternative consultation measures for minor London Plan amendments and zoning by-law amendments.

WHEN COUNCIL’S DECISION IS FINAL: The proposed official plan amendment is exempt from approval by the Minister of Municipal Affairs and Housing. The decision of the Council is final if a notice of appeal is not received on or before the last day for filing a notice of appeal.
