Anyone wishing to speak at a Public Participation Meeting can do so virtually using Zoom online or phone, or by attending in person. The Planning and Environment Committee will consider the following matters at a Public Participation Meeting to be held Tuesday, February 21st, 2023. Standing Committee and Council Meetings are virtual meetings hosted in City Hall, Council Chambers. 1930-1940 Oxford Street East – The purpose and effect of this zoning change is to expand the range of permitted uses on the subject lands. Possible change to Zoning By-law Z.-1 FROM a Restrictive Service Commercial (RSC1/RSC4/RSC5) Zone which permits a range of moderate intensity commercial uses, and trade service uses, which may require significant amounts of land for outdoor storage or interior building space and a location on major streets, TO a Restrictive Service Commercial (RSC1/RSC2/RSC3/RSC4/RSC5) Zone to expand the range of permitted uses on the subject lands. NOTICE OF APPLICATION

The following applications have been received by the City of London.  The Planning and Environment Committee will be considering these applications at a future public meeting, the date and time of which will be published in the Londoner.  If you have any questions or would like to provide comment, please see “Providing Comment” below.

City-wide Additional Residential Unit Review in response to Bill 23 (More Homes Built Faster Act, 2022). On November 28, 2022, the Province received Royal Assent on Bill. Among other changes, the changes to the Planning Act would still have the effect of allowing a total of three units on a lot containing a single detached, semi-detached, or street townhouse dwelling but all units could be located in the main building or have one unit located in a detached building. The purpose and effect of these London Plan and/or zoning changes is to implement these recent changes to the Planning Act made by Bill 23. In December 2021 Council approved London Plan and Zoning By-law changes as a result of the passage of Bill 108 (More Homes, More Choices Act, 2019) to allow a total of three units on a lot containing a single detached, semi-detached or street townhouse dwelling; however, the main building could only contain two units and the detached building one unit. Maximum size of units, number of bedrooms permitted, parking regulations and the need for site plan approval for detached structures were also included. Bill 23, besides allowing three units in the main building, may have the effect of removing the maximum unit size and number of bedroom regulations and need for site plan approval for any detached building. Additional changes to be considered include removing minimum dwelling unit sizes in Section 4.6 (2)(b) in Zoning By-law Z-1. File: OZ-9581/City of London Planner: Chuck Parker ext. 4648

h-5 – The purpose and effect of this zoning change is to amend the h-5 Holding Zone to exempt Public Site Plan Meetings for residential developments with 10 or fewer units in accordance with the provisions of Bill 23. Possible change to Zoning By-law to revise the wording of the h-5 Holding Zone to permit interim permitted uses. Street Width Policy Review – The purpose and effect of these Official Plan and Zoning By-law amendments is to add alternative street widths in The London Plan and clarify the planned street widths for the Main Street Classification and modify the requirements for alternative street widths. Additionally, a Zoning By-law amendment will delete Section 4.21, 4.21.1 and 4.21.2 of Section 4 General Provisions of Zoning By-law Z.1. File: OZ-9584. Planner: I. de Ceuster ext. 3835

135 Villagewalk Boulevard – SPA23-005 – Consideration of a site plan to permit the development of a food store and retail stores. The zoning on this site includes two holding  provisions: to ensure that development takes a form compatible with adjacent land uses, agreements shall be entered into following public site plan review specifying the issues allowed for under Section 41 of the Planning Act, R.S.O. 1990, c. P.13 and to ensure that new development is designed and approved consistent with the policies of the Sunningdale North Area Plan and the “Upper Richmond Village-Urban Design Guidelines”, to the satisfaction City of London. NOTICE OF INTENT TO REMOVE A HOLDING PROVISION

City Council will consider removing the Holding Provisions as applied to the lands described below at a future Council Meeting. Council will not hear representations from the public on these matters.  If you have any questions or comments about this matter, please call the planner identified below.

604 Beaverbrook Avenue – The Delegated Authority for the City of London intends to consider removing the h-18 holding provision from the subject lands to allow for the development of two (2) residential staked townhouses.  The purpose of the “h-18” provision is to ensure that the proponent shall retain a consultant archaeologist, licensed by the Ministry of Tourism, Culture and Sport (MTCS) under the provisions of the Ontario Heritage Act (R.S.O. 1990 as amended) to carry out a Stage 1 (or Stage 1-2) archaeological assessment of the entire property. Development or property alteration shall only be permitted on the subject property containing archaeological resources or areas of archaeological potential if the archaeological resources have been conserved by removal and documentation, or by site preservation (Stages 3 and 4). The archaeological assessment must be completed in accordance with the most current Standards and Guidelines for Consulting Archaeologists. Engagement with the appropriate First Nations shall be completed consistent with the policies of The London Plan. All archaeological assessment reports, in both hard copy format and digitally in Portable Document Format (PDF), will be submitted to the City of London once MTCS has accepted them into the Public Registry. Significant archaeological resources will be incorporated into the proposed development through either in situ preservation or interpretation where feasible, or may be commemorated and interpreted on site. No demolition, new exterior construction, grading, or any other activity where soil disturbance will occur or might be reasonably anticipated shall take place on the subject property prior to the City of London receiving the MTCS compliance letter indicating that all archaeological licensing and reporting requirements have been satisfied. If a person or public body would otherwise have an ability to appeal the decision of the Corporation of the City of London or of the Approval Authority to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the City of London before the application is adopted or approved, the person or public body is not entitled to appeal the decision.
If a person or public body does not make oral submissions at a public meeting or make written submissions to the City of London before the proposed amendment is adopted or approved, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.

City Council is seeking applications from individuals interested in being considered for appointment to fill one (1) vacancy on the Committee of Adjustment.

Committee of Adjustment conducts public hearings and is the decision-making authority on applications for minor variances and consents on properties.  Meetings take place every Thursday at 1:30 p.m.

Residents of the City of London who are at interested in being considered for an appointment are asked to obtain, complete and submit by no later than Thursday, February 16, 2023 at 9:00 a.m., an application form that is available on the City’s website at London.ca/boards-commissions; or by telephoning 519-661-2489 ext. 4599.

Applicants should be aware that all applications received will be considered in public
