NOTICE OF REVISED APPLICATION

The following applications were received and advertised on a previous date in The Londoner and have since been REVISED.  The Planning and Environment Committee will be considering these applications at a future public meeting, the date and time of which will be published in the Londoner. If you have any questions or would like to provide comment, please see “Providing Comment” below.

1856-1870 Oxford Street West – The purpose and effect of this Official Plan and Zoning change is to permit a mixed-use development with a commercial podium consisting of 840m2 of ground floor commercial uses and  two 10 & 11 storey residential towers consisting of 223 residential units. Possible amendment to The London Plan to ADD a Specific Area Policy to permit a mixed-use development with 840m2 of ground floor commercial along with two 10 & 11 storey residential towers within the Neighbourhood Place Type. Possible change to Zoning By-law Z.-1 FROM a Commercial Shopping Area Special Provision (CSA5(6)) Zone TO a Commercial Shopping Area Special Provision (CSA5(  )) Zone. Special provisions would permit a mixed-use development with apartment buildings an additional use a; permit a minimum front and exterior side yard setback of 0.0 metres as permitted under the current zone; permit a minimum interior side yard setback of 2.0 metres, whereas 4.5 metres is required; permit a height of 40.0 metres whereas 12.0 metres is required; minimum long term bicycle parking spaces of 0.45 spaces per unit whereas 0.9 spaces per unit are required; a maximum of 223 residential units; a maximum of 840m2 commercial; and to permit stand-alone buildings that do not form part of a shopping centre as permitted under the current zone. NOTICE OF APPLICATION

City-wide 5-Bedroom Limits and Increased Permissions for Additional Residential Units The purpose and effect of this Official Plan and Zoning By-law amendment is to revise the city-wide bedroom limit and amend provisions related to Additional Residential Units (ARU). Proposed amendment to Official Plan Policy 942 and 942.1 to permit ARUs within duplex, triplex, and converted dwellings; permit up to two ARUs within a maximum of one accessory building; and amend wording when referring to ARUs within accessory buildings. Possible amendment to Zoning By-law Z.-1 to: amend Section 2 Definitions to remove the bedroom limit city-wide, except within Near Campus Neighbourhoods (NCN) areas and include proposed amendments to NCN bedroom limits; amend Sections 4.1 and 4.37 provisions related to building height, setbacks, number of units per building, and lot coverage related to ARUs; amend Section 4.19 to permit front yard parking where an attached garage is converted into an ARU; amend Section 4.26 to define zones where ARUs are a permitted use; amend Section 4.37 to include ARU permissions for duplex, triplex, and converted dwellings, in conformity with the proposed Official Plan amendment; amend Sections 5, 6, 7, 8 of the Residential Zone Regulations tables to include a maximum of four units per lot for dwelling types where ARUs are permitted. 1982 Commissioners Road East and part of 1964 Commissioners Road E – The purpose and effect of this zoning change is to facilitate the development of a two-storey townhouse building, containing 7 units, and a three-storey back-to-back (stacked) townhouse building containing 12 units for a total of 21 residential units at a density of 60 units per hectare. Possible change to the Zoning By-law Z.-1 FROM an Urban Reserve (UR4) Zone TO a Special Provision Residential R5 (R5-7(_)) Zone. Special Provisions include a front yard depth of 3.0 metres whereas 8.0 metres is the minimum required; and rear yard depth of 1.5 metres whereas 3.0 metres is the minimum required; and a north interior side yard depth of 1.8 metres w whereas 3.0 metres is the minimum required. NOTICE OF INTENT TO REMOVE A HOLDING PROVISION 

City Council will consider removing the Holding Provisions as applied to the lands described below at a future Council Meeting.  Council will not hear representations from the public on these matters.  If you have any questions or comments about this matter, please call the planner identified below.

2770 Buroak Drive – The Delegated Authority for the City of London intends to consider removing the h, h-54, h-71, h-95, and h-100 holding provisions from the subject lands to allow for the development of one (1) elementary school.  The purpose of the “h” holding provision to ensure the orderly development of lands and the adequate provision of municipal services, the “h” symbol shall not be deleted until the required security has been provided for the development agreement or subdivision agreement, and Council is satisfied that the conditions of the approval of the plans and drawings for a site plan, or the conditions of the approval of a draft plan of subdivision, will ensure a development agreement or subdivision agreement is executed by the applicant and the City prior to development. The purpose of “h-54” holding provision to ensure there are no land use conflicts between arterial roads and the proposed residential uses, the h-54 shall not be deleted until the owner agrees to implement all noise attenuation measures, recommended in noise assessment reports acceptable to the City of London. “h-71” holding provision to encourage street orientation development, the Owner shall prepare a building orientation plan which demonstrates how the front façade of the dwelling units can be oriented to all abutting streets (except where a noise barrier has been approved), acceptable to the General Manager of Planning and Development. The recommended building orientation will be incorporated into the approved site plan and executed development agreement prior to the removal of the “h-71” symbol. The purpose of “h-95” holding provision to ensure that the urban design concepts established through the Official Plan and/or Zoning amendment review process are implemented, a development agreement will be entered into which, to the satisfaction of the General Manager of Planning and Development, incorporates these concepts and addresses identified Urban design issues. The purpose of “h-100” holding provision to ensure there is adequate water service and appropriate access, a looped watermain system must be constructed and a second public access must be available to the satisfaction of the City Engineer, prior to the removal of the h-100 symbol. 600 Sunningdale Road West – The Delegated Authority for the City of London intends to consider removing the h and h-18 holding provision from the subject lands to allow for the residential development. The purpose of the “h” holding provisions is to ensure the orderly development of lands and the adequate provision of municipal services, the “h” symbol shall not be deleted until the required security has been provided for the development agreement or subdivision agreement, and Council is satisfied that the conditions of the approval of the plans and drawings for a site plan, or the conditions of the approval of a draft plan of subdivision, will ensure a development agreement or subdivision agreement is executed by the applicant and the City prior to development. The purpose of the “h-18” provision is to ensure that the proponent shall retain a consultant archaeologist, licensed by the Ministry of Tourism, Culture and Sport (MTCS) under the provisions of the Ontario Heritage Act (R.S.O. 1990 as amended) to carry out a Stage 1 (or Stage 1-2) archaeological assessment of the entire property. Development or property alteration shall only be permitted on the subject property containing archaeological resources or areas of archaeological potential if the archaeological resources have been conserved by removal and documentation, or by site preservation (Stages 3 and 4). The archaeological assessment must be completed in accordance with the most current Standards and Guidelines for Consulting Archaeologists. Engagement with the appropriate First Nations shall be completed consistent with the policies of the London Plan. All archaeological assessment reports, in both hard copy format and digitally in Portable Document Format (PDF), will be submitted to the City of London once MTCS has accepted them into the Public Registry. Significant archaeological resources will be incorporated into the proposed development through either in situ preservation or interpretation where feasible, or may be commemorated and interpreted on site. No demolition, new exterior construction, grading, or any other activity where soil disturbance will occur or might be reasonably anticipated shall take place on the subject property prior to the City of London receiving the MTCS compliance letter indicating that all archaeological licensing and reporting requirements have been satisfied. If a person or public body does not make oral submissions at a public meeting or make written submissions to the City of London before the proposed amendment is adopted or approved, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.

CITY SERVICES DURING THE 2023 HOLIDAY CLOSURE – A number of our offices, programs and services are closed from noon on December 22, 2022, and will reopen at 8:30 a.m. on January 2, 2023.

Special inspections on holidays  –  can be conducted based on staff availability. A holiday special inspection, up to max 3 hours, excluding fire protection inspection, flat fee is $687.92. A holiday special inspection, up to max 3 hours, for fire protection systems, flat fee is $859.88. The holiday inspection requests and required fees need to be submitted no later than December 15, 2023.

Life Stabilization – Ontario Works

Offices are open on December 27 and 28 from 8:30 a.m. to 4:30 p.m. and on December 29 from 8:30 a.m. to noon.

Case status and cheque information for ongoing Ontario Works clients:

Recreation and Sport

Customer Service will be available via e-mail, phone and in-person at the Citi Plaza location on December 27 & 28 from 8:30 a.m. to 4:30 p.m. and December 29 from 8:30 a.m. to noon.

Arenas & outdoor skating rinks
